GENERAL OPERATING RULES AND CONDITIONS

Article 1

DEFINITION

  • For all purposes the parties agree to the following definitions
  1. Company: Ipark Estacionamientos y Servicios de Movilidad S.A.U. with CIF A 01516640 and address Camino de las Ceudas 2, 1st floor, Las Rozas, 28232 Madrid.
  2. Airport Parking Mallorca: or just Parking, managed by the Company (Ipark S.A.U.), outdoor or covered and with strict admission to third parties, and facilities of other entities that have an agreement with Airport Parking Mallorca within a 6 km radius.
  3. Client: Individual or collective person who will use the Parking under the conditions provided for in this agreement.
  4. Vehicle: Vehicle-car or motorcycle that the client, in any legitimate capacity, has at its disposal, it does not include any accessory property not incorporated therein, and that could be stolen.
  5. Airport: The International Airport of Palma de Mallorca, in whose vicinity the Airport Parking Mallorca parking lot is located

 

Article 2

OBJECT OF THE CONTRACT

The purpose of this contract is the provision of the Airport Parking Mallorca parking facilities and facilities of other entities, which have an agreement with Airport Parking Mallorca within a radius of 6 km, for the duration periods agreed between the client and the Company, observing the other conditions provided for in the following clauses

Article 3

DURATION OF CONTRACT

This contract will have the duration agreed in each case between the Client and the Company, without prejudice to the fact that this period may be extended or reduced, by communication between the parties

In the case of prior/prepaid reservations, cancellations with less than 48 hours and schedule modifications will be free, but if the client wishes to modify the reservation dates, they will have to request cancellation and process their reservation again. again.

Said contract may be automatically canceled in the following cases:

  • Delivery of the vehicle later than the reserved time. If after more than 120 minutes of the reserved time, the client does not deliver his vehicle, said reservation will be cancelled.
  • Breach of contract by the client.
  • If the parking staff sees it appropriate (lack of respect, attacks or repeated non-compliance with parking conditions,…)

 

Article 4

CONDITIONS

  • Without prejudice to the rest provided for in this Contract, with its subscription the Clients will be assured the following benefits:
  1. Store the Vehicle in the Airport Parking Mallorca Parking Lot, or in facilities of other entities, which have an agreement with Airport Parking Mallorca within a radius of 6 km for the duration of this Contract
  2. Airport Parking Mallorca reserves the right to move the vehicle between the parking lots and facilities of other entities that have access to it, their parking lots and facilities for better optimization of the parking spaces available to it.
  3. The collection of the client’s vehicle at the airport (Valet/Driver Car) to Airport Parking Mallorca and vice versa, as specifically agreed between the parties, will be carried out by duly identified and authorized company collaborators.
  4. Transportation will be free of charge for the Client from the Airport Parking Mallorca to the Airport and vice-versa. This will be arranged by the Company, in accordance with what is specifically agreed between the Client and the Company.
  5. Other benefits that may be provided by the Company, such as washing the vehicle, taking the car to the workshop, changing the battery,…. may be offered at any time by the Company and specifically agreed with the Client;

 

  • The attribution of the benefits conferred in the previous point presupposes that:
  1. The key of the Vehicle will be delivered by the Client to authorized representatives of the Company, when it is deposited in the Airport Parking Mallorca Parking Lot or its collection at the Airport (Valet/Driver Car), which will be parked in the facilities of Airport Parking Mallorca or in facilities of other entities that have an agreement with Airport Parking Mallorca, within a radius of 6 km.
  2. The authorized employees of the Company may, at any time, proceed to move the Vehicle within the Airport Parking Mallorca Parking lot in order to allow the movement of other vehicles from the Airport Parking Mallorca Parking Lot that are meanwhile removed by others. Clients, or in any case allow the optimization of the parking spaces of the Airport Parking Mallorca Parking Lot;
  3. Airport Parking Mallorca reserves the right to move vehicles between the parking lots and facilities of other entities, which provide the company with their parking spaces, for better optimization of the parking spaces available.
  4. Authorizes the driving of the vehicle from the airport to Airport Parking Mallorca or facilities of other entities that have an agreement with Airport Parking Mallorca within a radius of 6 km from the airport without the need for prior agreement.
  • In the event that the Client contracts the service for a period of more than one month and with periodic payments, payments will be made through direct debit receipts that the Company will issue between the 1st and 5th of each month. In the case of return of the receipt, the Company may charge the return costs to the Customer.
  • In the case of contracting the parking service for a fixed period, payment will be made in advance and expires with the end date. In the event that the Client decides to remove the Vehicle before the designated date, they may do so without the right to a refund of any amount by paying the total price agreed in this Contract. If the withdrawal is later than the agreed date, the Client will settle the amount at the daily prices in force on the date of withdrawal of the Vehicle, unless expressly indicated in this Contract.
  • Annual and semi-annual contracts expire at the end of the date. The customer is obliged to make his own efforts to renew the contract. The email letter and the notice that the contract expires are not binding and can only be considered as a service. This also means that customers cannot refer to lost mail traffic when the contract expires and possibly additional costs.
  • In the event that the Client contracts the Battery Recharging Service, the Client authorizes through this Contract that the Company connect the cables to the battery terminals.
  • In the case of contracting the parking service with online payment (pre-paid). 100% of the money paid will be refunded if canceled 48 hours before the performance of said service, 50% will be refunded if it is between 48 hours and 24 hours before the service. And nothing will be refunded if canceled less than 24 hours after performing said service. This cancellation will only be valid when it is communicated by email to info@airport-parking-mallorca.com accompanied by the reservation number correspondent. If the withdrawal is later than the agreed date, the Client will settle the days pending payment, paying the amount at the daily prices in force on the date of withdrawal of the Vehicle.

ONLINE PURCHASE PROCESS

  1. To purchase the Services offered on the Website, the Client must follow the instructions shown on the screen and accept the purchase by complying with the aforementioned instructions.
  2. If the Client is a natural person, they must be at least 18 years old to purchase the Services.
  3. The contract will be carried out by the Client completing the different forms that are presented throughout the entire purchase process and the express acceptance by the Client of these Terms and Conditions and all applicable conditions. to the contracted product. In the purchase process, sending the form once completed, pressing the “Pay and Complete Purchase” button will complete the process and will imply full acceptance by the Client of the commercial proposal of Airport Parking Mallorca and of the applicable conditions, redirecting to an on-screen purchase confirmation page, which the Customer can print.
  1. Article 5

COMPLEMENTARY CONDITIONS AND PRICE

 

  • The delivery of the Vehicle will depend on the procedure agreed between the client and the company, that is, by direct delivery at Airport Parking Mallorca or by the procedure of collecting the vehicle at the airport (Valet/Driver Car) before boarding by a duly authorized collaborator. uniformed and identified, always taking into account the check-in procedures referred to in article 7.

 

  • Reception of the Vehicle will depend on the Client’s prior request, in one of the following modalities:
  1. Prior information, (through reservations) by request made online on the website, at the time of delivering the Vehicle, or by telephone communication, or e-mail, indicating: flight, company, date and time of return of the client, with an indication of the delivery method, which may be direct (delivery at the terminal, Valet/Driver Car) or free transportation from the terminal to Airport Parking Mallorca.
  2. By communication to a duly identified collaborator of the Company present at the Airport or by telephone contact with the Company, notifying of the Client’s presence and requesting delivery of the Vehicle at the terminal or in the park with free transportation. The Client accepts that in this case the procedure for receiving the Vehicle may be delayed or denied.
  • The price to be paid by the Client will be the one stated in the price table shown or, failing that, the price of the online simulator ( airport-parking-mallorca.com) (each fraction is 24 hours, partial or hourly periods are not billed). Payment will be made online (pre-payment), or in the final act of delivering the vehicle, taking into account the chosen procedure (Park/Valet) and the period used (always at POS, we do not accept cash.)

 

Article 6

CUSTOMER OBLIGATIONS

The Client undertakes before the Company to:

  1. Deliver the Vehicle in full mechanical condition, in full working order and with all the technical reviews and inspections, as well as with all the legally required documentation (under the framework of Spanish legislation), that adequately certifies the availability of the Vehicle by the Client and its movement by employees of the Company in the terms of clause 4.1 b) and c)
  2. Deliver the keys to the Vehicle (in any Park/Valet mode) that allows access to it or its mobility; the alarm control if it is autonomous and even any other control that allows the alarm to be deactivated if necessary;
  3. Allow access to the interior of the Vehicle and its driving by the Company’s collaborators, under the terms and for the purposes of clause 4.2
  4. Any other access to the Vehicle is excluded, with the exception of situations resulting from orders coming from entities with powers of authority, Police and judicial officials or with powers of public order;
  5. Carry out the check-in and check-out procedures provided for in clause 7, signing the corresponding documentation;
  6. Make sure you remove all belongings from your vehicle that are not necessary to drive or park it (in particular all personal or valuable effects)
  7. Authorize the Company, through its collaborators, to remove from the Vehicle, after its delivery, any element incorporated into it, more easily noticeable, such as antenna and other accessories, which must be placed in the Vehicle at the time of delivery;
  8. The customer is responsible for all damage caused by technical defects that may be caused by the vehicle delivered to the IPARK area
  9. Pay the price of the services object of this contract in the terms of the price table in force at any time or, failing that, the price of the online simulator (airport-parking-mallorca.com);
  10. Authorize the company to maneuver and park the vehicle in the parking lots of Airport Parking Mallorca and in facilities of other entities that have an agreement with Airport Parking Mallorca, within a radius of 6 km.
  11. In the event of an accident, clients accept the repair of the vehicle in the workshop arranged by Airport Parking Mallorca to the detriment of any other.
  12. Customers whose vehicle is on public roads, in the event of an accident, must always activate the mandatory vehicle insurance.

 

Article 7

VEHICLE DELIVERY AND RECEIPT

  • The delivery of the Vehicle, whether by immediate delivery at the Airport Parking Mallorca Parking Lot, or delivery of it at the airport (Valet/Driver Car), will take into account the following points:
  1. a) The client must deliver the Vehicle without any property that is not an integral part of it, whether in the passenger compartment or in the suitcase, namely communication equipment, radios, computers, cameras, clothes, glasses, money , etc.…. or any other physically subtractable property; for which Airport Parking Mallorca does not assume any responsibility.
  2. b) The Client and the representative of the Company must proceed to a check-in of the Vehicle, in which a search will be carried out inside and outside it, and photographic records may be carried out, in order to record damages, wear or defects existing on the delivery date. This record will be kept in the company’s possession for up to 3 days after the vehicle is delivered.
  3. c) Likewise, if the client requests it, the subscription of the Company’s reception document is carried out, in which the kilometers of the Vehicle, fuel level and other facts that may be relevant for the purposes of the Company’s responsibility are declared. ;

2) The receipt of the Vehicle by the Client, whether at the airport or in the Airport Parking Mallorca parking lot, will be preceded by a check-out of the Vehicle, with a registration carried out by the Client, in order to confirm if it was requested the Vehicle Kilometers, fuel level, etc., as well as the absence of damage or any liability on the part of the Company. Any claim that the Client intends to make must be made at the Company’s facilities in the Parking Lot. The responsibility of Airport Parking Mallorca expires when the vehicle leaves our facilities or is delivered in accordance with the airport terminal.

3) Taking into account the reception and Check-out to be carried out in the terms of the previous clause, any claim that the Client may present regarding damages or deficiencies of the Vehicle must be submitted within a maximum period of 3 business days. after the date of receipt, under penalty of lapse of the Client’s right to claim any damages.

4) In the absence of a reservation or express claim by the client at the time of return of the vehicle by the Airport Parking Mallorca valet at the airport or in the Airport Parking Mallorca parking lot, it will be considered that the client recognizes that his vehicle is in the same condition it was in before delivery. No claim may be accepted in case of violation of these formalities and deadlines by the client

Article 8

COMPANY RESPONSIBILITY

1.- The Company will be responsible to the Clients for damages that are negligently caused by its employees, strictly in the following cases:

  1. a) Damage caused to the Vehicle as a consequence of its handling within the Airport Parking Mallorca Parking Lot and other facilities of other entities, which have an agreement with Airport Parking Mallorca, within a radius of 6 km, for the purposes provided for in clause 4.2;
  2. b) Any damage suffered by the Client and his companions as a consequence of transportation, in the terms of clause 4.1c) d) as long as they are caused by an illegal act due to gross negligence or fraud on the part of the employees. of the Company that performs the functions of driver of the transport Vehicle in question;
  3. c) Any other damages that occur as an unlawful act with intent or serious negligence on the part of the employees and representatives or agents of the Company and whose liability cannot be excluded under the terms of clause 7.2;
  4. e) Airport parking Mallorca, has the right to deny the delivery of a vehicle in its company area if possible dangers to the safety of the IPARK Estacionamientos y Servicios de Movilidad SA company become known, due to the entrance or the permanence of said vehicle in the company area. Likewise, you may refuse to transport people who are visibly under the influence of alcohol or other drugs (of any kind).

2 The Company’s liability with respect to:

is expressly excluded.

  1. a) Damage suffered by the Client related to theft of any property left in the Vehicle after its delivery, as provided in clause 6.1f); 7.1 a);
  2. b) Any mechanical damage to the Vehicle that is not caused by Company employees, including damage caused by third parties as a result of their illegitimate intrusion into the Airport Parking Mallorca Parking Lot, notwithstanding the perimeter closures, alarm and mounted surveillance, or due to disasters or natural causes beyond being avoided by the Company;
  3. c) Airport Parking Mallorca’s insurance policy does not cover any damage resulting from natural catastrophes or adverse meteorological phenomena.
  4. d) We are not responsible for isolated glass breakages.
  5. e) Recommendations for the delivery of the vehicle; Airlines recommend 3 hours of advance notice for international flights and 2 hours for domestic flights. Although it takes only a few minutes to receive your vehicle and transport it to the terminal, the parking user must arrive at our facilities 20 minutes before the opening time of your flight check-in. We are not responsible for the loss of your flight.

            The company is not responsible for the loss of your flight, if you do not comply with the check-in and if you do not arrive with sufficient advance notice or if the courtesy transportation service is delayed, for example, due to excess traffic, meteorological phenomena, delays when entering curbsides due to them being full, etc…

  1. The punctuality of arrival is not the subject of the contract, payments for damages regarding this term are excluded.
  2. The company will never be responsible for any problem your vehicle has when starting, due to mechanical/electrical failure, problems with the windows, flat or airless tires, existing damage to the bodywork or lack of battery. We are only committed to helping as much as possible, and the client cannot claim for these
  3. Paint damage that is not caused by structural damage is excluded. Small scratches, nicks and scuffs that affect the paint and/or parts of the vehicle that are not a consequence of structural damage to the vehicle (hit and/or friction with a vehicle, column or other object, which deforms, dents and/or displaces one or more parts of the vehicle). This also excludes damage to the underside of the vehicle and damage that is not noticeable due to its dirt.
  4. Airport Parking Mallorca is not responsible for payments made to intermediaries and their return and cancellation policies, and therefore declines any responsibility in this regard.
  5. Damage to luggage: The company is not responsible in any case for dents, scratches, stains, broken handles, closures and/or wheels that occur in the luggage during handling and transfer to the airport and vice versa.

The company will not be responsible for damage to perishable and fragile items transported in luggage.

 

3 Airport Parking Mallorca reserves the right to move vehicles between the parking lots and facilities of other entities, which make their spaces available to it, for better optimization of the parking space available.

 

4 Airport Parking Mallorca is obliged to refund the parking value only when the client misses the flight.

 

Article 9

CUSTOMER RESPONSIBILITY

9.1) The Client will be responsible for any fines, sanctions, or liabilities that the Company has to pay due to any irregularity verified in the Vehicle, in its documentation or in its ownership (within the framework of Spanish legality). . Without prejudice to the rights of defense that the Company has in the terms permitted by Law, the Client must reimburse the Company for all costs it has incurred, including legal costs with lawyers and solicitors.

9.2) In the event that the Client does not pay the contracted price or any other expense borne by the Company, the Company has the right of retention over the Vehicle, which will be released as long as the debt value is fully paid. , which will include the price due due to the increase in days of parking of the Vehicle plus interest on late payment.

9.3) The understanding of the general rules and conditions of the service in Spanish. Airport Parking Mallorca is not responsible for any damages or losses that may be caused to the client or a third party due to failure to understand them.

9.4) The client agrees to deliver/collect his vehicle during Airport Parking Mallorca business hours (from 04:00 to 23:59 each day). If the pickup/delivery is outside of Airport Parking Mallorca’s business hours, the customer agrees to pay an extra cost of €20

 

Article 10

PERSONAL DATA PROTECTION

In accordance with Regulation (EU) 2016/679 and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, you are informed that your personal data will be incorporated into processing. of data whose purpose is the management of the service contracted by the Company. Legitimation is based on the consent of the Client and for the execution of this Contract. Other bodies of the State Administration, the Autonomous Community of Madrid or the Municipality in which the Airport Parking Mallorca facilities are located may be recipients. Clients may exercise their rights of access, rectification, deletion, opposition and limitation to processing, by sending a written request to: info@airport-parking-mallorca.com or Camino de las Ceudas 2, 1st floor, Las Rozas, 28232 Madrid..

 

Article 11

VARIOUS PROVISIONS

All communications between the parties that result in alteration of this contract will be made in writing and addressed by the client to the address, fax, e-mail of the Company and by the Company to the Client’s residence indicated in the particular conditions. .

 

Article 12

CONVENTION FORUM

The validity, interpretation and effects of this Contract/Service will be governed exclusively by Spanish laws.

The Parties, expressly waiving their rights to submit to any other jurisdiction, submit to the courts and tribunals of the jurisdiction of Santiago de Compostela (Spain) for the resolution of any dispute, claim or controversy arising from or in relation to this Agreement, including any question relating to its existence, validity, termination, nullity or effectiveness.

PRICE TABLE

  1. MINIMUM FRACTION: 24 HOURS, ONLINE PRICES ACCORDING TO RESERVATION (PARTIAL PERIODS OR SCHEDULED PERIODS ARE NOT BILLED).
  1. TRANSPORTATION/PICK-UP OF PASSENGERS TO THE AIRPORT: FREE
  2. TAX FOR PICKUP/DELIVERY AT THE AIRPORT (VALET/DRIVER CAR): INCLUDED IN THE PRICE
  3. ALL PERIODS ARE 24 HOURS, EXCEPT THE LAST DAY WHICH HAS 4 HOURS TOLERANCE FOR POSSIBLE DELAYS.
  4. ALL PRICES INCLUDE VAT. AND TAXES IN FORCE.
  5. PRICES ARE THOSE PRACTICED ONLINE FOR EACH TIME OF CONTRACTING.
  6. IN THE EVENT THAT THE CUSTOMER HAD TO REMOVE THEIR VEHICLE OUTSIDE THE PARKING OPENING HOURS, THIS SERVICE WILL HAVE AN EXTRA COST OF €20 PER STAY.
